C. Identification of the Copyrighted Work
A clear description of the copyrighted work you claim has been infringed (e.g., photographs, videos, artwork, written material, software, music, graphics, or other original works). If multiple works are covered by a single notice, please provide sufficient information for each.
D. Identification of the Allegedly Infringing Material
Specific information sufficient to locate the material, such as:
- Exact webpage URL(s)
- Product page URL(s)
- Download page URL(s)
- Image URLs
- Direct links
- File names
- Screenshots (optional but recommended)
General descriptions such as “your website contains my content” may not provide enough detail to identify the allegedly infringing material.
E. Good Faith Statement
A statement substantially similar to:
“I have a good-faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.”
F. Accuracy Statement
A statement substantially similar to:
“The information contained in this notification is accurate, and under penalty of perjury, I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
G. Signature
Your physical or electronic signature. Typing your full legal name at the end of an email generally satisfies the electronic signature requirement.
9. How to Submit a DMCA Notice

Submitting a notice through other channels — including social media, live chat, or unrelated support tickets — may result in processing delays.
10. Review and Verification Process
Upon receiving a copyright complaint, WinsHub may:
- Review the submitted information
- Verify that the notice substantially complies with applicable legal requirements
- Request additional documentation or proof of ownership/authorization
- Examine the allegedly infringing material
- Conduct an internal investigation
- Contact the reporting party or affected user
- Preserve evidence relating to the complaint
- Consult legal counsel where appropriate
WinsHub is not obligated to immediately remove content upon receiving every complaint. We reserve the right to determine whether a notice substantially complies with applicable law and whether further verification is warranted before taking action.
11. Temporary Removal or Disabling of Access
Where appropriate, WinsHub may temporarily remove or disable access to allegedly infringing material during an ongoing investigation.
Temporary removal does not constitute:
- An admission that infringement has occurred
- A determination regarding ownership
- A finding of legal liability
- Acceptance of the reporting party’s claims
Likewise, a decision not to immediately remove content should not be interpreted as a finding that no infringement exists. Each complaint is reviewed individually based on the available facts and applicable law.
12. Requests for Additional Information
WinsHub may request additional documentation from the reporting party where necessary to verify a claim, including:
- Proof of copyright ownership
- Registration certificates (where available)
- Licensing agreements
- Agency authorization
- Identity verification
- Additional URLs or original source files
- Publication dates
- Other documentation reasonably necessary to evaluate the complaint
Failure to provide requested information within a reasonable timeframe may result in closure of the review without further action.
13. Fraudulent or Abusive Notices
WinsHub takes abuse of the DMCA process seriously. Submitting knowingly false, misleading, incomplete, repetitive, or bad-faith copyright notices may result in:
- Rejection of the notice
- Suspension of future submission privileges
- Account restrictions, where applicable
- Referral to legal counsel
- Any other remedies available under applicable law
Nothing in this Policy limits the rights of any party under Section 512(f) of the DMCA or other applicable laws concerning material misrepresentations in copyright notices. All parties are expected to act honestly, accurately, and in good faith throughout the copyright complaint process.
14. Counter-Notification Procedure
If you believe that material you submitted was removed or disabled due to mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g).
A valid counter-notification must include:
- Your full legal name
- Your mailing address
- Your telephone number
- Your email address
- Identification of the material that was removed or disabled, and its prior location (URL)
- A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification
- A statement consenting to the jurisdiction of the Federal District Court for the judicial district where your address is located (or, if outside the United States, any judicial district in which WinsHub may be found), and agreeing to accept service of process from the original complainant or their representative
- Your physical or electronic signature
Counter-notifications should be sent to our designated Copyright Agent using the contact information provided in this Policy.
15. Restoration of Material
Upon receiving a valid counter-notification, WinsHub may provide a copy to the original complainant.
Unless the original complainant notifies us that they have initiated a court action seeking to restrain the alleged infringement within the time permitted by applicable law, WinsHub may restore the removed or disabled material in accordance with the DMCA.
WinsHub reserves the right to decline restoration where:
- Restoration would violate applicable law
- A court order prohibits restoration
- The material independently violates our Terms & Conditions or other policies
- The material presents security, fraud, or abuse concerns
- Other lawful grounds exist for maintaining the removal
16. Repeat Infringer Policy
WinsHub maintains and reasonably enforces a policy addressing repeat copyright infringement.
Users who repeatedly violate the intellectual property rights of others may be subject to enforcement actions including, but not limited to:
- Written warnings
- Temporary suspension of account privileges
- Permanent account termination
- Removal of uploaded or submitted content
- Revocation of download privileges
- Cancellation of purchases or licenses where permitted by law
- Restriction from creating future accounts
- Any other action deemed appropriate by WinsHub
WinsHub retains sole discretion in determining what constitutes repeat infringement, taking into account the number, nature, credibility, and frequency of infringement claims.
17. User Responsibilities
Every user of the Services is responsible for ensuring their activities comply with applicable intellectual property laws.
By using WinsHub, you represent and warrant that:
- You own or have secured all necessary rights to any content you upload, submit, distribute, or otherwise make available
- Your activities do not infringe the copyrights or other intellectual property rights of any third party
- You will not knowingly submit false copyright notices or counter-notifications
- You will cooperate with reasonable requests for information in connection with copyright investigations
Users remain solely responsible for the legality of their actions and any content they provide through the Services.
18. Third-Party Hosting and Delivery Services
WinsHub may utilize third-party infrastructure, cloud storage, content delivery networks, payment processors, or file hosting services to facilitate the delivery of digital products and Services.
Use of such providers does not transfer content ownership to those providers.
Where allegedly infringing material is hosted or delivered through a third-party service, rights holders may also need to submit notices directly to that provider in accordance with its own policies.
WinsHub cannot guarantee the actions or response times of independent third-party service providers.
19. No General Duty to Monitor
WinsHub operates as an online service provider and does not undertake a general obligation to monitor all content, files, communications, or activities conducted through the Services for potential copyright infringement.
The absence of proactive monitoring shall not be interpreted as knowledge of, approval of, or participation in any allegedly infringing activity.
WinsHub reserves the right — but is under no obligation — to investigate, review, remove, restrict, or disable access to content at its discretion when such action is deemed appropriate or required by law.
20. Reservation of Rights
Nothing in this Policy limits WinsHub’s right to:
- Remove or restrict access to content at any time
- Decline publication of any material
- Suspend or terminate user accounts
- Preserve evidence relating to investigations
- Cooperate with courts, government authorities, or law enforcement
- Pursue legal remedies available under applicable law
- Enforce our Terms & Conditions or other published policies
WinsHub may take action independently of, or in addition to, the procedures described in this Policy where permitted by law.
21. Limitation of Liability
To the fullest extent permitted by applicable law, WinsHub shall not be liable for any loss, damage, expense, liability, or claim arising from:
- Removal or disabling of allegedly infringing material
- Failure to remove material
- Restoration of material following receipt of a valid counter-notification
- Delays in processing notices
- Errors or omissions in notices submitted by third parties
- Good-faith compliance with applicable copyright laws
Nothing in this section limits any liability that cannot lawfully be excluded under applicable law.
22. International Copyright Claims
Although this Policy is primarily based on United States copyright law and the DMCA, WinsHub respects valid intellectual property rights recognized under applicable international laws and treaties.
Where appropriate, WinsHub may review and respond to copyright complaints submitted under other applicable legal frameworks.
Nothing in this Policy obligates WinsHub to apply foreign legal procedures where United States law governs the operation of the Services.
23. Record Retention
WinsHub may retain records relating to copyright notices, counter-notifications, correspondence, investigations, enforcement actions, and supporting documentation for as long as reasonably necessary to:

26. Severability
